The [Non-Fungible Films Casting Call] (“Casting Card”) is held by Non-Fungible Films, Inc. (“NFF”) and open to: (i) any owner of an official Pudgy Penguin, and (ii) who enters the Casting Call according to these terms and conditions (“Terms”). You may enter during the Casting Call Period by emailing your Character’s serial number and associated NFT artwork, accompanied by a written submission of your Character’s fictional story (“Character Story”) to [email protected] (“Submission”). By entering the Casting Call, you agree that your Submission is gratuitous and made without restriction, and will not place NFF under any obligation to select or use your submission, that NFF is free to use or otherwise disclose the ideas contained in the Submission on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your Submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. Submissions that are selected by NFF will be notified via email to the email address that sent the selected Submission. You will not be notified if your character is not selected. NFF understands and acknowledges your intellectual property rights in the underlying Character NFT, and if NFF selects your Character, NFF will negotiate in good faith a license for use of the NFT and its associated artwork.
